Visionary Services, Inc. Terms of Use

Users shall not attempt to bypass the firewall, security policies, or similar software or hardware devices installed by Visionary Services, Inc. to protect its systems or the systems of its customers.

Site users may not upload text or images to sites hosted or maintained by Visionary Services, Inc. which contain material of obscene, racist or extreme political nature, or which incites violence, hatred or any illegal activity.

Users may not engage in any activity that would disrupt or interfere with the general use of our services or the services of our customers.

Disclaimer

Visionary's services are provided on an "As Is" and "As Available" basis. Visionary does not warrant that the services will be uninterrupted, error-free or free of viruses, or other harmful components. Visionary makes no express warranties and waives all implied warranties including, but not limited to, warranties or title, noninfringement, merchantability, and fitness for a particular purpose regarding any merchandise, information or service provided through Visionary or the internet generally. No advice or information given by Visionary or its representatives shall create a warranty. Visionary and its employees, offices and directors are not liable for any costs or damages arising directly or indirectly from your use of the Services or the internet including any indirect, incidental, exemplary, multiple, special, punitive or consequential damages.

Intellectual Property Rights

The copyright and all other intellectual property rights to the Site OnCall content management system and all related files in PHP, MySQL, HTML, CSS, etc. is owned exclusively by Visionary. Upon full payment, clients are assigned a non-exclusive license to use the Site OnCall system provided that they continue to run the site on Visionary's servers and pay for all hosting charges associated with the developed site. Upon payment in full, clients becomes the owner of their specific content, design, graphics and web pages but not the Site OnCall system which must run on Visionary’s servers. Further, it is agreed that a client's ownership of the developed website shall not include any pre-existing works created by Visionary. For any such pre-existing work, Visionary grants a perpetual, non-exclusive and royalty-free license to its clients to use such pre-existing works in connection with the website. It is also agreed that for all intellectual property generated, conceived or developed by Visionary that Visionary shall have a world-wide, perpetual, royalty-free, fully paid up and right in license to use such intellectual property for future developments.
